PARKING TERMS & CONDITIONS

Daily, Monthly & Annual Customers

JAX Parking Specialists LLC  d/b/a  Airlynk Parking

These Terms & Conditions (the “Terms”) govern the use of the off-airport parking facility located at 1759 Airport Road, Jacksonville, FL 32218 (the “Facility”) operated by JAX Parking Specialists LLC, a Florida limited liability company doing business as Airlynk Parking (“Airlynk,” “we,” “us,” or the “Company”). They apply to every customer who parks a vehicle at the Facility, whether on a daily, monthly, or annual basis (“Customer,” “you,” or “your”). By parking a vehicle at the Facility, reserving online, or signing a parking agreement, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

PLEASE READ CAREFULLY. You park entirely at your own risk. Airlynk provides a parking space only and is not responsible or liable for any loss, theft, or damage to your vehicle or its contents during your stay. You are responsible for maintaining your own insurance.

1.  License to Park Only — No Bailment

Your use of the Facility creates a license to use a parking space only. It does NOT create a bailment, deposit, trust, or any similar relationship between you and Airlynk. Airlynk does not take custody or control of your vehicle (the “Vehicle”) at any time. You retain possession and control of the Vehicle, you keep your keys, and you park, secure, and retrieve the Vehicle yourself.

You acknowledge and agree that you park the Vehicle and leave it at the Facility entirely at your own risk.

2.  Limitation of Liability — Parking at Your Own Risk

TO THE FULLEST EXTENT PERMITTED BY LAW, AIRLYNK SHALL NOT BE LIABLE, AND YOU HEREBY RELEASE AIRLYNK FROM ALL LIABILITY, FOR ANY DAMAGE, LOSS, THEFT, VANDALISM, FIRE, COLLISION, WEATHER EVENT, OR OTHER HARM TO THE VEHICLE OR ANY PROPERTY LEFT IN OR ON THE VEHICLE, REGARDLESS OF CAUSE, INCLUDING WITHOUT LIMITATION ANY ACTS OR OMISSIONS OF THIRD PARTIES, OTHER CUSTOMERS, OR AIRLYNK’S OWN EMPLOYEES OR AGENTS (EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW).

This release and limitation includes, without limitation, any damage, loss, or harm caused by:

  • Other vehicles entering, leaving, or maneuvering within the Facility;
  • Fallen branches, hail, flooding, wind, storms, or any other weather event;
  • Theft, attempted theft, break-ins, or vandalism;
  • Animals;
  • Fire or smoke;
  • Electrical or mechanical malfunction; and
  • Any condition of the Facility surface, pavement, markings, or lighting.

You assume all risk of loss for the Vehicle and its contents for the entire period the Vehicle remains at the Facility, from drop-off until you actually retrieve it.

3.  Customer’s Own Insurance — Mandatory

You are solely responsible for maintaining, throughout the entire period the Vehicle is at the Facility, comprehensive automobile insurance and any other insurance reasonably necessary to cover loss of or damage to the Vehicle and its contents. Airlynk does not provide, and shall not be required to provide, insurance coverage of any kind for the Vehicle or its contents.

In the event of any loss, damage, theft, or other claim arising while the Vehicle is at the Facility, you shall pursue recovery solely through your own insurance carrier(s) and shall not look to Airlynk for compensation. By parking at the Facility, you warrant that your own insurance is or will be in force during your stay and is sufficient to cover any claim that may arise while the Vehicle and any property contained in it are parked at the Facility.

4.  Personal Property

You are strongly advised NOT to leave valuables, electronics, luggage, firearms, cash, identification documents, medications, or any other personal property in the Vehicle. Any personal property left in or on the Vehicle is left at your sole risk, and Airlynk shall have no responsibility whatsoever for its loss, theft, or damage. The Limitation of Liability (Section 2) and Customer’s Own Insurance (Section 3) provisions apply with equal force to all such personal property.

5.  Customer Obligations

You agree that you shall:

  • Lock the Vehicle and remove the keys when leaving it at the Facility;
  • Park only in marked, lawful parking spaces, follow posted signage, and obey the directions of Facility staff;
  • Not leave the Vehicle at the Facility in an inoperable condition, leaking fluids, or otherwise creating a hazard; and
  • Warrant that the Vehicle is lawfully owned or operated by you and is properly registered and insured under applicable Florida law.

6.  Shuttle Service & Operating Hours

Airlynk provides complimentary shuttle service to and from Jacksonville International Airport (JAX) during operating hours. Shuttle service is offered as a convenience and is subject to availability, traffic, weather, and operational conditions. Airlynk is not responsible for missed flights or other losses arising from shuttle timing or delays, and recommends that you allow ample time for your transfer.

7.  Term, Retrieval & Abandoned Vehicles

Your parking term begins when you park the Vehicle at the Facility and ends when the Vehicle is retrieved and all charges are paid in full. If the Vehicle is not retrieved within thirty (30) days after the anticipated pickup date (for daily customers) or after termination of a monthly or annual plan, and you cannot be reached, Airlynk may treat the Vehicle as abandoned and proceed under Section 713.78, Florida Statutes.

8.  Storage Lien

If any amount payable to Airlynk remains unpaid, Airlynk shall be entitled to a possessory lien on the Vehicle pursuant to Section 713.78, Florida Statutes, and may exercise all rights and remedies thereunder, including without limitation the right to retain possession of the Vehicle, charge continuing storage fees, send statutory notices, and sell the Vehicle at a public sale to satisfy the lien. Payment terms are further described in the separate Payment Terms & Conditions, which form part of your agreement with Airlynk.

9.  Indemnification

You shall indemnify, defend, and hold harmless Airlynk and its owners, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Facility; (b) the condition or operation of the Vehicle; (c) any property left in or on the Vehicle; or (d) your breach of these Terms, except to the extent caused by Airlynk’s gross negligence or willful misconduct.

10.  General Provisions

  1. Governing Law & Venue. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Venue for any dispute shall lie exclusively in the state or federal courts located in Duval County, Florida.
  2. Entire Agreement. These Terms, together with any signed parking agreement and the Payment Terms & Conditions, constitute the entire agreement between the parties regarding their subject matter and supersede all prior agreements and understandings, written or oral.
  3. Severability. If any provision of these Terms is held unenforceable, the remaining provisions shall continue in full force and effect.
  4. Notices. Notices to Airlynk shall be sent to 1759 Airport Road, Jacksonville, FL 32218 by certified mail. Notices to you shall be sent to the address or email on file.
  5. No Waiver. Failure of Airlynk to enforce any provision shall not be deemed a waiver of that provision or of any future enforcement right.
  6. Amendments. These Terms may be updated by Airlynk from time to time; the version in effect on your drop-off or billing date applies to that stay or billing period.

11.  Acknowledgement

By parking at the Facility, reserving online, or signing below, you acknowledge that you have read, understood, and agree to be bound by every provision of these Terms & Conditions, including the limitation of liability and your assumption of all risk described above.
